Service Cover Terms and Conditions
“The Company” refers to Breaktime Coffee and Vending Ltd or its successors or assignees.
“The User” is defined as the legal entity that identifies itself upon the initial order.
- The Contract
- The contract will encompass the equipment specified in the schedule once all payments owed to The Company by The User are received in full.
- Service Cover is described as offering repair and maintenance services for the equipment outlined in The Schedule within a reasonable timeframe upon notification. The target response time is 24 working hours. This service will be accessible during The Company’s regular working hours, Monday through Friday, from 08:30 to 18:00.
- All parts utilized in repairing or maintaining the machines will be provided by The Company in adherence to the equipment manufacturer’s parts warranty terms and conditions.
- Certain parts are excluded from the contract’s coverage, and The Company retains the right to impose charges for call-outs.
- Parts that have been damaged or service calls that have been made due to vandalism, mishandling, theft, or attempted theft will not be covered under the warranty terms.
- Parts that have been damaged or service calls that have been made due to the use of incorrect or unsuitable ingredients or products are not eligible for warranty coverage.
- Parts that have been damaged or service calls that have been made due to the use of incorrect, foreign, badly damaged, or counterfeit coins will not be covered under the warranty.
- Parts that have been damaged or service calls that have been made due to the user’s operator staff or contractors’ practices during the equipment’s filling and cleaning process are not included in the warranty coverage.
- Parts that have been damaged or service calls that have been made due to the loss, damage, or delayed replacement of hygiene components when worn are not covered by the warranty terms.
- Parts that have been damaged or service calls that have been made due to using the equipment beyond its designed capacity and/or capability are not eligible for warranty coverage.
- Parts that have been damaged or service calls that have been made due to water scale damage are not included in the warranty terms.
- Parts that have been damaged or service calls that have been made due to equipment failure resulting from external influences are not covered under the warranty.
- Parts that have been damaged or service calls that have been made due to restricted ventilation to the refrigeration unit are not eligible for warranty coverage.
- Parts that are not included in the equipment manufacturer’s warranty will not be covered under our warranty terms & conditions.
- Service calls may be initiated for reasons unrelated to a machine fault, and in some cases, our technicians may not identify any faults upon inspection.
- If access to the site or keys for equipment is unavailable during a service call or machine installation, the service call may be aborted.
- Repairs or service calls for fridge units or electronic boards in machines older than 3 years may incur additional charges.
- Service calls or repairs related to cashless systems are the responsibility of the cashless system provider under their contract conditions and terms.
- The services not covered under the terms of this contract are as follows:
- Cashless Payment Systems. For assistance, please contact your cashless system provider (NAYAX, VIANET, Payter, etc.) directly.
- Adjustment to beverage dispensers after a change of products dispensed, unless agreed upon by the company in writing.
- Adjustment to food or snack vendors after a change in size, shape, or weight of items to be vended, unless agreed upon by the company in writing.
- Changes in vend prices or changes in the range of accepted coins.
- Cleaning and/or sanitizing of equipment due to poor performance by The User’s staff or contractors in carrying out cleaning routines, or faults caused by negligence on the part of The User’s staff or contractors.
- Training of The User’s operator staff or contractors beyond the initial training provided by The Company.
- Responsibilities such as changing gas bottles, lights, and filters are routine tasks that should be handled by the user’s staff and/or contractors.
- The Company Agrees
- Upon acceptance of an order along with the receipt of the appropriate payment, we will provide The User with the following service: On-site equipment repair service (as per paragraph 1) and conduct preventative maintenance checks while on-site and/or during water filter exchanges.
- We will install and commission the equipment at The User’s premises, conditional upon The User completing and returning a satisfactory site survey.
- Our commitment includes training The User’s designated staff or contractors in the procedures related to the proper use and operation of the equipment.
- As part of our service, we will supply water filter cartridges twice a year on all hot drink dispensing equipment.
- Charges
- In the duration of the minimum maintenance contract, the total maintenance fee for the listed machines in the schedule shall be the amount specified on the invoice at the time of contract initiation.
- The initial fee is required to be paid upfront upon signing this agreement, and each subsequent fee should be settled in advance along with the equipment rental schedule.
- Assignment & Transfer of Contract
- The Company reserves the right to assign this contract, in whole or in part, to any of its approved contractors at its discretion to fulfill its obligations effectively. However, the contract cannot be transferred or reassigned without written agreement from both parties.
- In consideration of the foregoing terms, the User hereby agrees to the following stipulations:
- The User shall grant The Company’s service staff unrestricted access to the equipment during reasonable times.
- The User shall permit the installation of master locks as necessary by The Company, with expenses incurred in this regard to be the responsibility of the User.
- The User shall undertake the cleaning and sanitization of the equipment to the standards set forth by The Company, ensuring compliance with the Health and Safety at Work Act.
- The User shall release The Company from any liability regarding failure to meet obligations due to events such as force majeure, fire, storm, war, civil unrest, or any other uncontrollable circumstances affecting either party.
- The User shall hold The Company harmless from any losses incurred to the User’s stock or revenue from the equipment, irrespective of the cause of such loss.
The schedule of equipment included in this contract will align with the details listed in the original contract invoice(s).
